1) In connection with your request to receive information about the terms of a post-warranty repair or about the Service Centre’s products and services, including as regards installation services/appliance connection services, an overhaul, the purchase of a Gwarancja Plus warranty, or as regards ordering any products or services offered by the Service Centre, Amica S.A. of Wronki informs you that the controller of your personal data shall be the following companies from the Amica S.A. group (hereinafter referred to as the Group):

a) Amica Spółka Akcyjna of Wronki, entry No. in the National Court Register KRS 0000017514 – hereinafter referred to as AMICA; and

b) Amica Handel i Marketing Sp. z o.o. of Poznań, entry No. in the National Court Register KRS 0000373563 – hereinafter referred to as AHiM; and

c) Inteco Business Solution Sp. z o.o. of Poznań, entry No. in the National Court Register KRS 0000325012 – hereinafter referred to as INTECO; and together with the entities listed above, as the Joint Controllers.

As part of the joint control agreement concluded between the Joint Controllers, we have determined our respective responsibilities for compliance with the obligations under the GDPR; in particular, we have agreed that:

a) Amica S.A., a manufacturer of household appliances, is the leading company in the joint control model, and supervises the processing of personal data, identifies risks for the processing of personal data and sets security standards adequate to such risks, ensuring appropriate protection for all of the personal data processed within the Group. In particular, AMICA is responsible for the fulfilment of the duty to provide you with information and for enabling you to exercise your rights described below. Irrespective of the above arrangement, you may exercise your rights also with respect to each Joint Controller;

b) AHiM is responsible for the management of the www.amica.pl website;

c) INTECO provides and maintains the ICT infrastructure, grants and revokes rights to the systems used by the Joint Controllers, stores the data, implements technical protection measures, services the servers and creates backup copies. The company is also responsible for providing hardware to the Group companies’ employees.

 

2) The Joint Controllers have established one contact point for all personal data related issues.

3) Your personal data will be processed by the Joint Controllers, taking into account the split of responsibilities indicated above:

a) for purposes resulting from the legitimate interests pursued by the Joint Controllers in the form of providing information about the products and services of the Service Centre based on information and inquiries from you.

In the case of this purpose:

(i) the legal basis for the processing of your personal data is Art. 6.1.f of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regards to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter referred to as the “GDPR”;

(ii) the data recipients are: entities servicing the IT system where the personal data are processed;

(iii) your personal data are processed for six months as of their collection;

(iv) the scope of the processed data encompasses: name, surname, address, phone number, mobile phone number, e-mail address, country, fax;

(v) a data subject has the right to object to the processing – for legitimate reasons due to their particular situation;

b) in order to undertake necessary activities, at your request, prior to the conclusion of an agreement for a product or service offered by the Service Centre, selected by you.

In the case of this purpose:

(i) the legal basis for the processing of your personal data is Art. 6.1.b of the GDPR;

(ii) the data recipients are: processors processing your personal data on behalf of the controller/Joint Controllers, in particular: Amica’s authorised service centres, IT systems service providers, other controllers acting on their own behalf, in particular: postal operators or couriers;

(iii) your personal data will be processed until any agreement-related claims are time-barred;

(iv) the scope of the processed data encompasses: name, surname, address, phone number, mobile phone number, e-mail address, country, communication language, fax, and customer ID number and the case reference number assigned by the guarantor’s system;

c) for purposes resulting from the legitimate interests pursued by the controller in the form of developing and keeping statistics related to products and services.

In the case of this purpose:

(i) the legal basis for the processing of the personal data is Art. 6.1.f of the GDPR;

(ii) the data recipients are: processors processing the personal data on behalf of the controller/Joint Controllers, IT systems service providers, other controllers, in particular: consultants;

(iii) the personal data are processed for ten years;

(iv) the scope of the processed data encompasses: name, surname, address, phone number, mobile phone number, e-mail address, country, communication language, fax, and customer ID number and the case reference number assigned by the guarantor’s system;

(v) a data subject has the right to object to the processing – for legitimate reasons on grounds relating to their particular situation.

4) Your data are provided on a voluntary basis, but its provision might be necessary for the performance of an agreement concluded with you. You have the right to request access to the content of your data and to rectify them, to erase them, to restrict their processing and to transfer the data, in the circumstances set forth in the GDPR. You also have the right to lodge a complaint with a supervisory authority (the President of the Personal Data Protection Office) if you believe that the Joint Controllers have processed your data in breach of the GDPR provisions, and also to object to the processing – in the cases specified in Sections 3.a-c above.

5) Your personal data will not be transferred to any third country, and based on your personal data, the Joint Controllers will not take any automated decisions towards you.
