§1. Who is the controller of your personal data

 

The personal data controller is “Amica Spółka Akcyjna” based in Wronki, at ul. Mickiewicza 52 (64-510 Wronki), entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000017514, for which registration files are kept by the District Court Poznań – Nowe Miasto i Wilda in Poznań, NIP (Tax ID) 763-000-34-98 and REGON (Business ID) 570107305, share capital of PLN 15,550,546.00 (paid in full), BDO number 000008067.

 

§ 2. Data Protection Officer

 

The Controller has appointed a Data Protection Officer.

 

§ 3. Contact with the DPO

 

Regarding the protection of personal data, it is possible to contact our Data Protection Officer (Anna Hoffmann) via email sent to the following address: info.dane@amica.com.pl or by sending a letter to the following address: “Amica Spółka Akcyjna”, ul. Bułgarska 17, 60-320 Poznań with the note: “Dane osobowe”.

 

§ 4. Purpose, scope and legal basis for personal data processing

 

We process the personal data you have voluntarily provided to us during the account registration, i.e. your name and email address.

 

We can also process data related to appliance geolocation, which you can read more about in the next clause.

 

We process your personal data for the purposes of:

providing electronic services according to the rules described in the T&C of the Amica Home Application. The provision of our services is inseparable from the processing of personal data and without these activities we would not be able to perform our services for you;

performing marketing activities related to our activities, by means of electronic communication, e.g. email. We will perform such activities only based on your voluntary consent;

pursuing our legitimate interests. Our legitimate interest should be understood as: complaint processes, possible establishment, investigation and enforcement of claims or defence against claims, prevention of abuse and fraud, detection of unauthorized use of services, ensuring IT security of the application, conducting marketing activities, responding to user inquiries and messages, keeping statistics and performing analytical research and tests in order to better select services according to user needs or to optimise processes, profiling to best match the information to user needs and interests, storing data for archiving purposes and ensuring accountability.

 

§ 5. Location data / geofencing

 

When using the Amica Home Application, you can be asked to activate the location service. We need consent to location and enabled access to location for:

displaying the list of available WiFi networks;

connecting to the network created by the SmartIN oven and to the home WiFi network;

checking and downloading information about the network to which we are connected / network within range.

We pursue the said goals in the “Allow only when using the application” mode, i.e. not on a continuous basis.

In the case of geofencing service, we may have permanent access to the location service. You do not need to enable this feature. We encourage its use because its purpose is to ensure safety by informing you about leaving a safe zone (60 m from the oven) when your appliance is on. You will then be notified accordingly.

 

§ 6. Recipients of personal data

 

We may share personal data with the following categories of entities: entities providing services to us, e.g. companies providing data storage services, companies providing hosting services, companies providing assistance in marketing services, companies providing services in the field of company performance analysis (audit).

 

External entities are provided only with personal data directly related to the service provided to us in connection with the Amica Home Application. These entities are obliged to protect personal data and have no right to use them for any other purpose than to provide a service to us.

 

§ 7. Personal data storage period

 

Your personal data will be stored while there is a basis for storage, i.e.:

 

in the case of processing of personal data on the basis of consent, until its withdrawal;

in the case of processing of personal data being necessary for the performance of a contract, for the duration of its performance and until the expiry of the limitation of claims related to the subject of the contract, taking into account the limitation periods for claims specified in applicable law;

if the basis for data processing is a legitimate interest of the controller, until you object or the interest ceases to exist.

§ 8. Withdrawal of the consent

 

The consent you have given to personal data processing may be withdrawn at any time. The withdrawal of the consent does not affect the lawfulness of processing based on the consent before its withdrawal.

 

§ 9. Personal data processing rights

 

You have the right to access your personal data, the right to rectify them, as well as the right to request their erasure or restrict their processing. In cases specified by law, you have the right to data portability.

 

§ 10. Right to submit an objection

 

In the case of processing of personal data based on a legitimate interest, you have the right to object to the processing at any time.

 

§ 11. Right to lodge a complaint

 

You have the right to lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw).

 

§ 12. Consequences of not providing personal data

 

Providing personal data is necessary to create an account. For some methods of connecting to the oven, the creation of an account is necessary for the proper operation of the Amica Home Application.

 

§ 13. Automated decision-making

 

In the Amica Home Application we do not conduct operations that could qualify as automated decision-making.

 

§ 14. Safeguards

 

We apply appropriate technical and organisational measures to ensure the protection of the processed data, in particular we protect data against unauthorised access, unlawful processing and alteration, loss, damage or destruction.

§ 16. Changes to the Privacy Policy

 

We can update the Privacy Policy. In particular as the Amica Home Application develops. The change is visible by placing the new content of the Privacy Policy in the Application and displaying information about the policy change by changing the information about the last document update (information about document update is shown in the title section of the Policy).

 

In addition, we will inform you about the changes via an email.

 

§ 17. Final provisions

 

The User acknowledges that during processing their personal data may be transferred via the Internet or other remote data transmission systems.
